Court Slams GHC1000 Fine on OSP for Delay in Bissue Case Response!

Human Rights Court Orders Special Prosecutor’s Office to Respond Promptly to Ex-Official’s Judicial Review Request

In a recent court ruling, the Office of the Special Prosecutor (OSP) has been directed to address the application for a judicial review made by a former Secretary of the Inter-Ministerial Committee on Illegal Mining. The presiding judge, Barbara Tetteh Charway, has given the OSP a 14-day deadline to submit their response, and as a consequence of their failure to do so in a timely manner, a fine of GHC1000 has been imposed against the Special Prosecutor.

The legal counsel representing Charles Bissue, Nana Baffour-Awuah Agyei, expressed their view that it would be reasonable to afford the Office of the Special Prosecutor an additional opportunity to respond to their motion.

The court session has been adjourned until September 4, 2023.

Charles Bissue is contesting the Special Prosecutor’s decision to prosecute him for alleged corruption, which was highlighted in the Galamsey Fraud Part 1 documentary created by investigative journalist Anas Aremeyaw Anas and his team at Tiger Eye P.I.

In his application, the former Secretary of the Inter-Ministerial Committee on Illegal Mining (IMCIM) claims that the Special Prosecutor’s investigation violated Section 3(1)(b) of the Special Prosecutors Act 959, as it excluded Anas Aremeyaw Anas and Tiger Eye P.I. from the inquiry.
